Lost my License :(

as the title suggests i am losing my licence within the next week or so.. just waiting the RTA to deliver the date in a letter.

Kind of a weird way to get booked. Police officer claimed i ran a YELLOW light???? whats the go with that.. and i checked it up and found it is a legal rule.. Im kinda annoyed at it cause it includes a $318 fine with a loss of 3 demerit points..

1. that is the dummiest rule i have heard of.. i thought the yellow light was there as a means if you are unable to safely stop before it turns red.

2. $318 fine and 3 points.. WTFFF

Also i questioned the officer why i got the fine.. i asked is a yellow light like a red where you have to stop immediately even at risk of causing the car behind you to cause an accident? He just nodded.. (wa*ker)

Also i questioned if i was speeding or if i ran the red and replied i was doing the legal speed and was thru the intersection before the red.. BUT he thought i could of pulled up at the lights safely from his point of view..
ARGHHH i just wanted to hit him.. but managed to control myself lol :roll:

anyways it was my last 3 points on my license and i only JUSTT bought my liberty :( only had it for 1 month..

anyone else heard of this type of fine?

hmm speeding.. speeding and speeding would total the other 9 points :oops: but spread over a 3 year period of course lol

i was due to get 3 points back in december :cry:

I have never heard of it.. Maybe it’s just a NSW ruling… That’s a pretty shite rule thou.. I have been done for speeding and red light camera before (was driving next to a massive semi trailer in the city and just didn’t see the lights).. I took it all on the chin as I was definitely in the wrong, but if I ever got done for going through a yellow light I would be pi##ed… That would be like getting booked for going 102km/h in a 100km/h zone by a cop without radar…

If its your first time loosing your license you can usually go to court and go on a 3, 6, 9 or 12 month good behavior thing.. Where you have one or two points for the duration of the good behavior period.. You can also take ambiguous matters like that to court and get sometimes them reversed.. I have done it a few times..

Just tell them you saw the green light then noticed some dog near the intersection playing and thought it was about to run out on the road, then when you looked back up you noticed the yellow light but it was too late by then to stop, so you proceeded and made it through the intersection, without speeding & before it went red..

yeh i was soo p**sed off about it.. your right AdamW, its like getting caught for doing 102 in a 100 zone.

I already sent a letter in to the state debt recovery office and they pushed back saying in there exact words "The issuing officer reported you proceeded through the intersection while the traffic light was yellow, and indicated there was sufficient time and distance to stop the vehicle safely. Regardless of how close another vehicle is, you should always be ready to stop if needed"

This is the most BS i have even seen..
1. they say there was sufficient time to stop safely, well there was also sufficient time to proceed without speeding safely.. i made that judgement and the result was me crossing the intersection without the light being red and without speeding.

2. Regardless of how close another vehicle is.. so they expect you to slam on your brakes so u dont cross a yellow light and cause a accident?? how dumb are these people..
Did i mention at the time it was raining.. and they are aware of this in my initial complaint letter..

SO they have pretty much said, i pay the fine or go to court..
I have already paid the fine cause, i will prob lose the court battle due to my crappy driving record..

nah nobody in the car with me.. so no witness.. my word vs pigman..

im not usually like this with fines.. if i get court speeding i except it as i know i done the wrong thing.. but this YELLOW light thing is BS.. im really upset bout it :evil:

Well if you really wanted to, I don't see why you can't challenge the officer's decision.

I mean, he thought you could have stopped safely, but according to you, you didn't think you could have stopped in a safe manner. So thus proceeded forward through the light. I dunno, because it's not a clear thing like speeding where a radar reading says you were over the speed limit, to me this sounds like a he said/she said argument.

If you're supposed to stop at all yellows, then they would have simply removed it and just have green and red.

i was seriously considering court as an option.. but as i was saying my driving record sux.. already lost my license once before about 5 years back when i was a P driver..

so would be my word (someone with bad history) vs a mighty trustworthy police officer.. i didnt like my chances, unless i had a witness..

also i thought its my last 3 points.. so i am on a thin line as it is..

3 months no license then i get 12 points back... :wink:

my only prob now is getting to work.. anyone drive from liverpool to nrth ryde in the mornings :lol:

Ahh, how true. I guess with a less than perfect record to back you up, your word would weigh little. Sorry man.

Heh-heh. You should rent out your Lib in those 3 months you can't drive it to raise a bit of money. :D I wouldn't mind trying it out at the next track day for you. :D

You have always been supposed to stop at all yellows. It clearly says it in the Drivers Handbook in NSW.

NSW:
Yellow (amber) means stop.You
can enter the intersection if you
are so close that sudden braking
might cause a crash.

And Victoria.

Vic:
Yellow means STOP unless you are
unable to do so safely.


And Queensland.

Qld:
You must not drive past the STOP line at the
yellow traffic light or, if there is no STOP line,
the traffic light.
You must not drive in the direction of the yellow
traffic arrow past the STOP line at the traffic light
or, if there is no STOP line, the traffic light.
However, you may drive past the yellow traffic light
or arrow if you are so close to the light or arrow
when it changes from green to yellow, it is unsafe
to stop.

Someone else can look up SA, WA, NT, etc but I'm sure it's exactly the same. Hasn't changed in the 16 years since I got my licence.

this is the problem.. who decides when it is safe or unsafe.. at the time i thought i was safe to proceed.. but the pigman didnt agree..

so its a fine line.. not as accurate as u would like..

e.g. using arith example.. doing 102 in a 100 zone, you are speeding
run a red traffic light.. you broke the law.. but yellow is up in the air.. depends how the pigman/woman feels on the day

Was it hwy? If it was it will all be recorded and if you fight it it may cost you more than not fighting it.

I would fight it, IMO, what have you got to lose for a few days off work for court?

It's funny, when people get pulled over and asked why they ran the red light, they say no it was yellow, and bang just admitted the $300 ticket. However there are many more important jobs than giving bloody tickets.

Check with the RTA because I think you may (last time I checked with them) be able to drive with zero points.
