Tonight i was heading down King St in Newtown, cruising along looking for parking to go to a place for a friends 21st..

There was alot of traffic going the other way, they were all stopped cos of the lights..

Im cruising along, then all of a sudden through a gap of the cars obviously left for a street, a little red Lancer zips out.. I see it and slam on my brakes and quickly looked to see if there was room to swerve.. I swerved but because of their momentum they kept going and got the side of my car..

She managed to scuff my front right rim, and all down the side of my car..

She got the front right rim, front right quarter, put a nice dent in the lower part of the front door, scraped down the entire side of the body and even my rear bumper and put nice gash in my rear right rim..

I got her name, address, licence number and phone number.. But at the time didnt think to get her rego or whatever..

I've never been in this situation before, and don't really know what to do or what details I should have got.. But I think I got enough to get something done about it.. Plus have 3 witnesses who were in my car..


What is it I have to do now..? And any places you can recommend to get quotes for repair?

I hadn't got around to putting my wheels onto my insurance policy yet (stupid!) does that mean I can't get them fixed or replaced under insurance..?

Sigh, didn't that put a dampen on my night! lol..

I remained very calm, even though I had the shits.. and she was very apologetic and co-operative so I have a good feeling things should go smoothly, once I know what to do.. Going to call JustCar Insurance tomorrow..

If she had popped out 1 or 2 seconds earlier, i probably would have cleaned her up! .. 1 or 2 seconds later and she might have missed me or totally side swiped me!

#1 Ring her and get the rego no (must do this NOW)



#2 File a report with the police this is not a over kill but I could help you if things go wrong Dont worry about the cost of the repair the cops will try to put you off so as to save them time .It looks to be well over $500 any way


#3 Get 2 quotes from the best repairers in the business .Insurance company's and court always require 2 quotes and get the quotes done tomorrow . The reason for tomorrow is insurance company's sometimes try to get out of their responsibility's if any time has past they blame the damage was done after the accident

# 4 Ring her with the quote and see if she wishes to pay out of her own funds as she may not be insured .If she agrees to pay herself ask for a signed and witnessed letter stating that she was at fault and will pay. This could be the best option if you wheels are not covered

#5 If all else fails contact your insurance company and let them work it out that what you are paying insurance for .

dont worry about going to the police... they will not file a report unless someone was injured or suspected of drink driving.

if you have her address maybe go past her place, see if her car is out front and get the rego that way!

I had a similar situation and I rang my insurance company (AAMI) who took care of everything and they rang on my behalf to get the rego. You can ring the other party or provide what details you have to your insurance company. Good luck.

Sorry to hear about your car mate, just follow the good advice already given. If you're ever in a bingle again try and remember to get the name of the insurer, if they say they haven't got one report it directly to the cops. Hope everything turns out OK.

i had an accident in my sti and someone ran up the back of me on the M5. and the cops wouldn come out and told me not to come into the police station to make a report as they wont do them.

damage was about 5k.

but you're such a know all carry on....

According to the NSW Government Legal Aid website you should ring the Police Assistance Line (131 444) within 24 hrs of any motor vehicle accident. If you Google the Legal Aid site you can print out a pamphlet detailing the steps to take in the event of a car accident.

for the record i rang the 131 number posted above!

I rung the police aswell and they stated what Cat had written.

They threw out that over $500 worth of repairs rule ages ago. This was also confirmed by my insurance company, she said the police were getting calls for everything thats why they stopped it.

There was 3 things in which you can make a police report.

1. Whether a party was under the influence of alcohol.
2. Whether someone was injured.
3. Whether you car was undrivable and needed to be towed (i think thats the rule).

But yeah anyways im not gonna argue about whos right or wrong. Only that was my experience.

Tom dun worry i forgot the rego too when i was in the same situation. You dont think straight.

I reccommend dont waste your time with contacting the person directly. I had a old bloke who was clearly in the wrong who seemed nice about it but in his statement he was claiming i swerved into him after.

Do yourself the favour and write your own incident report with pictures and witness details to ensure you are not found at fault and so you can retrieve your excess.

If you need a repairer i know someone out Penrith who are also a Subaru preferred repairer. Theres about 10 subbys going in and out of that place weekly.

Well, i dont know if she was drunk or under the influence, didnt really think about that.. no one was hurt or injured (thankfully).. and both vehicles were working just fine.. so i suppose there actually wasnt any reason for the police to be involved, so its ok that i didnt contact them LOL..


Thanks for all the help guys! I was confused and had no idea how to go about it.. but you's all helped me out!

I figured I'd call my insurance company as soon as i got out of bed, and asked them whether i needed to contact the police.. the bloke said that i just need to give them the details, and they will work it out for me..

so they asked what i did from 10am on the day, right up until the incident.. so i gave them times, names, what i did, phone numbers when they asked, etc etc.. so things should hopefully go ok..

Then they gave me 2 repairers they want me to go to, to get quotes and then get back to them..

So i gave them every bit of detail of the story, names, times, phone numbers, streets, vehicles, etc etc.. so it should go fine i hope!!

I hate Newtown, they should do something about the traffic there.

There are so many incompetent people on the road........ we should have stricter licensing conditions and renewal process.

Argh! atleast you got details, except rego... but all in all you are not at fault and the car is still driveable.

Tom, if i remember correctly you are around the ryde/gladesville area?
if so, i've just had one of my cars done at JPL in gladesville(the street parrallel with and south of buffalo rd) who are a subuaru preferred repairer. They did an excellent job.
