I will try & find the page but im 99% sure that with the RTA (NSW) the issue they have is the fact that you can touch the filter element

If I remember somewhere, in NSW the issues that require covering the pod filter are noise pollution and fire hazard (needs to be separated from the engine bay)

NSW requires a closed box otherwise it makes it illegal. VIC is another story.
