This project has taken a turn for the worse. I have been advised that the freight company, has dropped the pallet/box that my engine and heads were in, damaging it. They will not tell us what is damaged as we are not the holders of freight account that was used to ship it down.
It isn't looking good for the little wagon that could. Or me.

It was on a freight account, so that is yet to be seen. I assume so.
If it was, all I want is my 2.65 closed deck, sleeved, billet cranked motor and worked heads back in the condition they shipped in.

They wont. They are saying the bottom fell out of the crate

Postby kiahatsiu » Mon Oct 21, 2013 9:00 pm

They are already trying not to pay up. They are saying the bottom fell out of the crate the motor was shipped in. It is the crate that Deshele uses to ship engines. I am currently in PNG and I am somehow going to have to chase this up. The heads were packed separately, details are sketchy at this stage as to what has been damaged.

This sounds familiar to the time I had a treadmill ordered from interstate (VIC) and delivered by freight via Toll Ipec... Toll dropped it causing severe damage (broken/bent frame) which only became apparent after opening. Because I had "accepted" delivery by signing they said I had accepted it was delivered in good order and denied damaging it (bullshit - how are you supposed to tell without opening and attempting assembly!?). And then the seller refused to take responsibility because I didn't pay for extra insurance. But this is wrong, the consumer has rights regardless. The seller is still responsible.

I ended up going to NSW Fair Trading (they're quite hopeless actually, because they can only make a recommendation and have no power to enforce anything), and then the CTTT (Consumer, Trader & Tenancy Tribunal). The seller was being completely unreasonable, but finally through the CTTT I did get a satisfactory outcome in the end (replaced frame) but it took almost 6 months to resolve.

Best of luck - I seriously hope your situation is resolved smoothly, dealing with these sorts of issues can be a major pain.

Not sure who the relevant/equivalent authorities to NSW Fair Trading & CTTT are in QLD, but I highly recommend you keep a log of every event / communication / e-mail etc. in relation to your issue (if you aren't already) as these can be invaluable - hopefully you won't need it but you never know!

I would just like to go on record as saying that I wish that the person at this particular freight company's soul mate gives them herpes.

Ian, I normally suggest trying to sort everything out without talking to lawyers, but dealing with freight companies is an exception. Whether you realise it or not, you're already in their process and it's a process designed to reduce claims by shafting you.

Lawyer up asap and have your scumbag send them some strong letters as to your expectations. My experience is that insurance is worthless and freight companies have a standard process to avoid taking any responsibility for anything.

They have turned avoiding responsibility into and art form and will run you around until you get sick of it and give up. Last time it happened to me, there was a offer to pay that was never honoured.

Okay, I will chase up a lawyer ASAP. It will be done in true car enthusiast way through PF though.
I will also go through the paper work of every biological sample I ever transport. I will look for every STD test I can find. I will keep them. I will then hire a PI to find out who dropped my crate, and also their significant other. I will find out where this significant other drinks. I will use my charms to get them into a position as to where I can, using some form of turkey baster to inject every STD known to man into their reproductive system. I will then activate my utility belt and ascend to safety. Feeling guilt and unsure about an encounter with a man with a utility belt the significant other will go home and have guilt sex with their crate dropping partner, transferring various forms of long strand DNA and strains of various STDs during this guilt ridden hollow intimate contact. Thus, giving me my revenge.
